Fulton Protection of public ordinance (§ 98-64)

Chapter 98: Streets, Sidewalks and Other Public Places · Article III. Excavations

In short: Anyone with a street excavation permit must barricade the hole and keep red lights burning all night: two for holes up to ten feet long, three for more than ten and less than 50 feet, plus one more per additional 25 feet.

Our plain-English summary, not the official text or legal advice. The ordinance below is what counts.

Every applicant for a permit under this article who shall make or cause to be made any excavation in or adjoining any street, avenue, boulevard, road, alley, highway, sidewalk or public easement shall cause the excavation to be barricaded. Such barricade shall be so placed as to prevent persons, animals or vehicles from falling into the excavation. Every applicant making or causing to be made any such excavation shall cause two red lights to be securely and conspicuously posted on or near such excavation, provided such excavation does not exceed ten feet in length. If the excavation is more than ten feet and less than 50 feet, three red lights, one at each end and one in the center, shall be so placed and one additional light shall be placed for each additional 25 feet or part thereof. Such lights shall be kept burning during the entire night.
