Fulton Restoration by city ordinance (§ 98-60)

If the person making an excavation under a permit issued under this article shall delay or refuse, after due notice from the city engineer, to restore such street, avenue, boulevard, road, alley, highway, sidewalk or public easement in or under which such excavation has been made to as good condition as it was prior to such excavation, it shall be the duty of the city engineer to make such restoration. The expense of the restoration shall be deducted from the deposit referred to in section 98-61, and the balance thereof, if any, after all lawful charges against it have been made, shall be returned to the person making such deposit.
