Fayette Worker's Compensation ordinance (§ 125.770)

Chapter 125: Personnel Administration System · Article VI. Leaves

A. A regular full-time employee who is temporarily disabled in the line of his/her duties as a City employee and as a direct result of employment shall become eligible for worker's compensation benefits in accordance with the program offered by and through the City of Fayette and its insurance carrier.

B. Any injury or illness on the job shall be reported to the Superintendent before the end of the employee's shift. The Superintendent will document the occurrence. All medical bills are paid from the time of injury by the insurance carrier.

C. Compensation for loss of time is based on two-thirds (2/3) of an employee's average weekly pay for the prior thirteen (13) weeks. The weekly minimum or maximum amount an employee may receive is established by law.

D. No compensation can be paid for the first three (3) days of the injury unless the disability exceeds fourteen (14) days. An employee will be carried on the department payroll for this three-day waiting period if he/she has adequate sick leave or vacation. An employee maintains the option of using part of or all of his/her accumulated sick leave prior to beginning worker's compensation, without loss of worker's compensation benefits.

E. Compensation for permanent, partial or total disability is also contained in these provisions, as well as death benefits in the event of a fatality.

F. The employee will not receive regular wages when drawing worker's compensation. Any wages paid to the employee during this period will be returned to the City over a period not to exceed six (6) months.

G. The City pays the total cost of the worker's compensation program. (Chapter 287, RSMo.)
