Fulton Mayor; Powers and Duties ordinance (Charter § 4.3)
City Charter · Article IV. Mayor
The mayor shall have the following powers and duties and shall perform the following functions in addition to those conferred upon him by other provisions of this charter and by all of the General Statutes of the State of Missouri:
(a) Presiding Officer During Council Meetings. He shall preside at the meetings of the council but shall have the right to vote only in the case of ties. He may call special meetings of the council as provided in section 3.10(a).
(b) The Power of Veto. He shall have the power to veto with respect to bills, resolutions and appropriation bills adopted by the council. When invoked this power shall be exercised pursuant to the provisions of this charter. Every bill or resolution adopted by the council shall be presented to the mayor for his approval and if the mayor shall sign the same, it shall be deemed approved and adopted. The mayor may return a bill or resolution with objections to the council unsigned within thirty (30) days and such bill or resolution shall stand vetoed and shall not take effect without approval of the mayor unless adopted over his veto in the following manner: No later than the regular meeting next following the receipt of a disapproved bill or resolution, the city council shall cause the objection of the mayor to be entered upon the journal of the council and the mayor shall put to the council the question, "Shall the bill or resolution take effect, the objections of the mayor notwithstanding." After discussion, the question may not be tabled and the clerk shall proceed to call the roll. Should six (6) members of the entire council cast their votes
in favor of overriding the mayor's veto, the bill or resolution shall take effect, otherwise it shall not take effect. Should the mayor neither sign nor return with objections any bill or resolution within (30) days of its adoption by the council it shall be deemed approved and adopted.
The mayor shall have the power to approve all or any part of any appropriation bill or the general appropriation of the city budget or veto any item or all of the same. The council may override such veto in the same manner as a bill or resolution provided six (6) members cast their votes in favor of overriding the mayor's veto before the veto override shall take effect.
(c) Execution of Laws, Ordinances, Resolutions, Rules and Regulations. He shall take care that the laws, ordinances, resolutions, rules and regulations of the city be faithfully executed. He may require oral or written reports and opinions from boards and commissions of the city except the judge of the municipal court.
In coordination with and through the director of administration or in the absence of the director of administration the mayor may require oral or written reports and opinions from the heads of all executive departments or from the heads of other departments.
(d) Appointment of Boards and Commissions. He shall have the power to appoint members of all boards and commissions provided for in the administrative code with the approval of the majority of the entire city council unless otherwise required by law.
(e) Administration of Oath. He shall have the power to administer oaths and affirmations and shall sign the commissions of all officers of the city except as otherwise provided in this charter.
(f) Execution of Documents. He shall sign all proclamations and executive orders and shall sign in behalf of the city all instruments, contracts, agreements, leases, deeds, mortgages and other instruments binding the city or conveying an interest in property or other right of the city to any other corporation, association, legal entity or natural person, when authorized by the council to do so.
(g) Messages to the Council. He shall from time to time deliver to the council orally or in writing messages suggesting to the council possible legislation and advising on matters which he deems should be called to the attention of the council.
(h) Budget and Capital Program. Each year he shall submit a budget and a three (3) year capital program for the ensuing fiscal year for consideration of the council as required by this charter.
(i) Administrative Policy Matters. He shall have the responsibility of discussing with the director of administration any and all policy matters; however, he shall not interfere with the day to day operation of city affairs.
(j) Remit Fines and Forfeitures and Grant Reprieves and Pardons; Exception. The mayor shall have power to remit fines and forfeitures and to grant reprieves and pardons for offenses arising under the ordinances of the city; provided, however, that this section shall not be construed as to
authorize the mayor to remit any cost which may have accrued to any officer of the city by reason of any prosecution under the laws and ordinances of the city. Notice of such action shall be made public at the next regular council meeting.
