Fulton Same—Failure to cut after notice ordinance (§ 98-9)

After ten days from the date of the service of the notice pursuant to section 98-8, if the owner of such fence or property or agent or person in possession of such land or property so fenced by such hedge shall fail or refuse to cut the hedge down to the required height, he shall be guilty of a misdemeanor. The city may trim such hedge or cause the hedge to be trimmed and charge the costs thereof to the owner; provided, however, that trimming by the city or its designee shall not preclude the imposition of a penalty.
