Fulton Prohibited practices ordinance (§ 94-95)

Chapter 94: Solid Waste · Article IV. Storage, Collection and Disposal

In short: It is unlawful to use someone else's trash container without written consent, interfere with collectors, burn solid waste, dump refuse in alleys, streets or vacant lots, or scavenge or scatter waste or recyclables; the landfill refuses items such as hazardous waste, tires and major appliances.

Our plain-English summary, not the official text or legal advice. The ordinance below is what counts.

(a) It shall be unlawful for any person to:

(1) Deposit solid waste in any solid waste container other than his own, without the written consent of the owner of such container, or with the intent of avoiding payment of the service charge provided in division 3 of this article for solid waste collection and disposal.

(2) Interfere in any manner with solid waste collection and transportation equipment or with solid waste collectors in the lawful performance of their duties as such, whether or not such equipment and collectors are those of the city.

(3) Burn solid waste, unless an approved incinerator is provided or unless a variance has been obtained from the appropriate air quality control agency.

(4)

Dispose of any refuse by depositing the refuse in any public alley, street, roadway, vacant lot or property of any kind or character within the city or belonging to the city or in any stream or body of water within the city or by burning garbage. However, nothing in this subsection shall be construed to prohibit the disposition of refuse by means of burning the refuse in an incinerator enclosed within a building and complying with applicable state law. Information obtained from waste disposed or deposited in violation of this subsection shall give rise to a rebuttable presumption that the person so identified committed the violation.

(5) Engage in the business of collecting, transporting, processing or disposing of solid waste within the corporate limits of the city without a permit from the city or operate under an expired permit or operate after a permit has been suspended or revoked. This permit is contingent upon the terms of this subsection and the specified type of solid waste and may be issued by the manager after the applicant obtains a city license.

(6) Scavenge or scatter any solid waste, including recyclables deposited by residents for pickup by solid waste collectors.

(b) The city shall not collect for disposal at its sanitary landfill nor shall it accept for disposal at its sanitary landfill any items prohibited by its license or by governmental bodies and agencies having jurisdiction, including but not limited to the following items:

(1) Hazardous waste.

(2) Infectious waste.

(3) Biomedical waste.

(4) Lead-acid batteries.

(5) Tires of any kind.

(6) Major appliances.

(7) Waste oil or oil of any kind, including oil filters or oily towels.

(8) Bulk liquids.

(9) Semisolids.

(10) Sludge.

(11) Highly flammable or volatile substances.

(12) Unexpended pesticide containers.

(13) Pesticides.

(14) Raw animal manure.

(15) Septic tank pumpings.

(16) Industrial process sludge.

(17) Radioactive waste.

(18) Explosives.

(c) Nothing in this section shall be construed to prohibit the city from establishing special pickup points or days to assist the residents of the city in disposing of the items mentioned in subsection (b) of this section.
