Fulton Marijuana facilities ordinance (§ 22-222)

(a) Marijuana dispensary facilities may dispense marijuana products to individuals in accordance with Article XIV of the Missouri Constitution and applicable state regulations, including sales to qualifying medical patients under the age of 21 as permitted by law.

(b) Marijuana dispensary facilities shall be permitted only in the C-2 Commercial, C-3 Planned Commercial, and M-1 Industrial zoning districts. No marijuana dispensary facility shall be located within 1,000 feet of a then-existing elementary or secondary school, state-licensed child day-care center, or church. Distances shall be measured in accordance with distance measurement. This subsection shall not be applied in a manner that effectively prohibits lawful marijuana facilities.

(c) All operations of a marijuana facility shall comply with Article XIV of the Missouri Constitution and applicable state regulations.

(d) The consumption of marijuana products within any marijuana facility is prohibited except as expressly authorized by state law or regulation.

(e) Any applicable marijuana license issued by the State of Missouri and the city business license shall be displayed in an open and conspicuous place on the premises at all times.

(f) No marijuana dispensary shall be located in a building that contains a residence. All activities of any marijuana facility shall occur only within an enclosed building.

(g) All marijuana facilities shall implement ventilation and odor-control systems in compliance with applicable state regulations. Such systems shall be designed to prevent odors from being detectable at the property line under normal operating conditions.

(h)

The waiting area of a marijuana dispensary facility shall be separated from the area used for the sale and delivery of marijuana products by a solid barrier, which may include reinforced glass or similar material, and a secure door.

(i) No marijuana product shall be visible through glass, windows, or doors from outside the facility.

(j) Marijuana facilities shall have adequate security including the following:

(1) Surveillance cameras shall monitor entrances and the premises. Recordings shall be preserved for at least 60 days.

(2) All inventory shall be stored securely.

(3) A secure vault shall be used for currency.

(4) Alarm systems shall be installed and maintained.

(5) Each facility shall maintain a security plan consistent with state law. The city may review and recommend reasonable modifications consistent with state law.

(k) Marijuana dispensary facilities may operate and conduct sales 24 hours per day, seven days per week.
