Fulton Tax ordinance (§ 22-106)

Chapter 22: Businesses · Article IV. Merchants

In short: Retail and wholesale merchants pay a license tax set by council schedule based on the prior calendar year's gross receipts; new businesses buy a temporary license and get a new license by the next March 1 or September 1, whichever is sooner.

Our plain-English summary, not the official text or legal advice. The ordinance below is what counts.

(a) Retail and wholesale merchants shall pay the tax specified in a schedule adopted by the council from time to time, based on a total gross volume of business or receipts for the previous calendar year.

(b) Every such person commencing any business shall procure a temporary license and pay therefor the minimum amount applicable to such business and at the next succeeding March 1 or September 1, whichever date is sooner, shall obtain a new license. The amount of such license tax will be determined and computed on a pro rata average gross business basis during the term such business was conducted under a temporary license, and such monthly average shall be multiplied by 12 or six, if a half-year license is required, to obtain the yearly anticipated gross sales or receipts. For each and every succeeding year thereafter, the amount of such license tax will be determined on a gross business basis per year as provided in this section.
