Fulton Operating requirements ordinance (§ 18-205)
Chapter 18: Buildings and Building Regulations · Article XII. Swimming Pools
In short: Public and commercial swimming pools, other than family pools and motel or hotel pools, must have one Red Cross-trained lifeguard on duty for each 50 persons in the pool area, plus health department-approved bather rules.
Our plain-English summary, not the official text or legal advice. The ordinance below is what counts.
(a) Any person owning or operating a swimming pool, other than a family pool or a pool operated as an ancillary service of a motel or hotel, shall provide and maintain the following:
(1) At least one lifeguard on duty and at an appointed station for each 50 persons in the pool area during the time that such pool is in use. Such lifeguard shall have completed the senior lifesaving course conducted by the American National Red Cross and shall have in his possession a valid, unexpired card duly authenticated to that effect. However, when organized classes are being
conducted by an educational institution, this subsection shall be satisfied by the presence of an appointed swimming instructor of the institution conducting the classes. All such lifeguards or instructors on duty must be physically able and fit to rescue any bather in danger of drowning.
(2) Rules for the conduct of bathers to minimize danger of injury to persons using the pool. All such rules shall be approved by the health department.
(3) Swimming pools operated in conjunction with a hotel or motel shall at all times when a lifeguard is not on duty have conspicuously posted at the entrance to the pool a sign with letters not less than two inches in height reading "no lifeguard on duty. Swim at own risk".
(4) A telephone in working order and the telephone numbers of the fire department and six available doctors posted adjacent to such pool, or the owner or operator of such pool shall provide some other manner or means approved by the health department of effectively summoning the fire department and a doctor.
(5) Convenient means of ingress and egress, and shall clearly mark or indicate the depth of water and any dangerous irregularities of the bottom.
(b) Any person owning or operating a swimming pool or family pool shall provide and maintain the water in such pool so that it is in conformity with section E4207 of the building code adopted in this chapter at all times when the pool is in use, except that natural bodies of water shall only be required to be certified free of pollution and approved for swimming by the health department.
