Boonville Collection fees ordinance (§ 21-181)

Chapter 21: Waters, Sewers and Solid Waste Disposal · Division 4. Solid Waste Disposal

(a) The service fee for each residential unit served (including two- and three-unit occupancies) shall be set forth in the city fee schedule.

(b) The service fee for multi-family dwellings receiving hand pick-ups, shall be based on the number of units and frequency of pick-up as set forth in the city fee schedule. As used in subsections (b) and (d) a multi-family dwelling is any dwelling equal to or exceeding four units.

(1) Each residential unit will be provided a contractor-owned container at no additional cost for the collection of residential waste. All containers shall be of at least 64-gallon capacity. Any residential unit may request the use of additional containers for a monthly fee that is set forth in the city fee schedule. (c) The service fee for commercial users receiving hand pick-ups shall be as set forth in city fee schedule depending upon the frequency of pickups per week. As used in subsection (c) and (d), a commercial user is deemed to include commercial, retail, wholesale, industrial, institutional, manufacturing and all other non-residential categories.

(d) The service fee for multi-family dwellings and commercial users receiving containerized service will be based on size of container and frequency of service per week as set forth in the city fee schedule.

(e) In addition to the service fees set out in subsection 21-181(a), (b), (c), and (d) there is also authorized and imposed a fuel surcharge fee per sanitation unit. The fee will be variable by quarter, calculated by city staff and the service provider as set forth in the service provider's contract with the city. The rate set forth shall be provided in the city fee schedule.

(f) The city shall be the final determining authority concerning all questions of classification under this section and may base such determination on time spent in collection and volume of solid waste collected.

(g) For purposes of this section, multi-family dwellings and trailer courts shall be charged on a residential basis for each separate, occupied unit contained therein. Owners of multi-family dwellings and trailer courts shall notify the office of the city clerk, in writing, before February 1, each year, of the total units owned or contained therein. Said owners may further notify the city clerk, on a month-to-month basis, of any vacancies occurring in one or more units, in which case the billing department shall be authorized to abate solid waste charges for all unoccupied units. Provided, however, that abatement of solid waste charges for vacant units shall apply to the next succeeding billing cycle following the billing cycle in which notice of vacancy is received and shall continue in effect during periods of continuous vacancy. Provided further, that abatement of solid waste charges shall not be given on a pro-rata basis, and shall be available only for periods of vacancy which cover an entire billing cycle.

(h) Failure of an owner of multi-family dwellings or trailer courts to provide the information and notice required in subsection (f) above shall be unlawful and shall be punishable as provided in section 1-9 of the Code of Ordinances.

(i) Service charges for single-family dwellings which are unoccupied may be abated under the same terms, conditions, and process as set forth for multi-family dwellings in section 21-181(g).

(j) The system of services established by the provisions of this article is designed as an integral part of the city's program of health and sanitation, to be operated as an adjunct to the city's system for providing sewerage disposal. The city may enforce collection of such charges by bringing proper legal action against the occupant of any dwelling unit or owner of any commercial establishment to recover any sums due for such services, plus a reasonable attorney's fee to be fixed by the court, plus the cost of such action.
