Boonville Extensions ordinance (§ 21-18)

Chapter 21: Waters, Sewers and Solid Waste Disposal · Division 1. Generally

In short: To have a water main extended, apply in writing and deposit the estimated cost; any difference from the actual cost is refunded or owed, and deposits earn no interest.

Our plain-English summary, not the official text or legal advice. The ordinance below is what counts.

(a) The water department will extend its water mains along roads, streets or approved easements upon proper written application and deposit by the applicant of the estimated cost of such extensions.

(b) The water department will make an estimate of the cost of the proposed extension. This shall be used as a basis for determining deposit required of the applicant.

(c) If actual construction cost is less than the deposit the difference will be refunded to the applicant. If actual construction cost is greater than the deposit the applicant will be required to make an additional deposit equal to the difference.

(d) Deposits will not bear interest.

(e) The water department will make refunds to the applicant or his authorized agent, for each permanent customer directly attached to the extension during the first ten years after the water main is installed as follows:

(1) At the time a permanent user is directly attached to the water main, the developer or his assigns shall receive a pro rata refund based upon the total number of lots in the subdivision, or the sum of $200.00 whichever is less.

(2) The total amount refunded shall not exceed the total amount deposited.

Nothing in this section shall be construed to prohibit the developer from assigning claim for refund; provided, however, written notice of said assignment shall be given by the developer to the superintendent of the board of public works, and provided, further, that said assignment shall be presented within the ten-year period set forth above.

(f) Where it is necessary for an applicant to construct an unproductive line to reach his productive extension, the applicant shall be refunded a proportionate cost of the unproductive line, provided that connections are made within the ten-year refund period. The refund shall be collected from the subsequent applicants as a part of their deposit and that part applicable to the unproductive line shall be refunded to the previous applicant or applicants.

The cost of the unproductive line chargeable to the subsequent applicant and refundable to the previous applicant shall be the proportionate cost of the jointly shared part of the unproductive line.

For each waterline that may be later attached directly to what was an unproductive line, the developer or his assigns shall receive a pro rata refund based upon the number of attachments made thereon, or the sum of $200.00, whichever is less.

(g) All work performed under this section shall be completed by the department of public works or its duly authorized agents and said work shall be approved by the division of health of the state.
