(a) User charges.
(1) It is determined and declared to be necessary and conducive to the protection of the
public health, safety, welfare, and convenience of the city to collect charges from all users who use the city's water system. The proceeds of such charges so derived will be used for the purpose of operating, maintaining, and retiring the debt for such public water system.

That portion of the total user charge which is designated for operation and maintenance including replacement of the water system shall be established by this subsection (a).
(4) Actual use rate structure.
a. Each user shall pay for the service provided by the city based on their use of the water system as determined by water meter(s) acceptable to the city. b. (5) a. All users shall be billed monthly, either in cycle one, two or three, occurring respectively on the 10th, 20th and 30th of each month. Payments are due when billings are made. Any payment not received within 25 days after the billing is made shall be delinquent.
b. A late payment penalty of $10.00 will be added to each delinquent bill. When any bill is 30 days in default, water service to such premises shall be discontinued until such bill, including all fees due, is paid following due notice and opportunity for hearing. Reconnection fees shall be paid by the customer. (6) a. The city shall review the user charge system annually and revise user charge rates as necessary to ensure that the system generates adequate revenues to pay the costs of operation and maintenance including replacement and that
the system continues to provide for the proportional distribution of operation and maintenance including replacement costs among user and user classes. b. The city will notify each user annually, in conjunction with a regular bill, of the rate being charged for operation and maintenance including replacement of the treatment works.
(b) The minimum charge to a water customer having a meter connection with the city's system shall be as stated, and said minimum rate shall be payable whether or not water is used so long as said water connection with the city's system is maintained.

The city shall annually charge each customer the fees assessed by the state per RSMo 640.100(5)(2) et seq. for the purpose of complying with federal requirements for maintaining the primacy of state enforcement of the federal "Safe Drinking Water Act." The annual fees are defined in the rules of Department of Natural Resources; division 60-Safe Drinking Water Commission; chapter 16-Drinking Water Fees; title 10 CSR 60-16.010.
