Kingdom City Main Extensions ordinance (§ 700.470)

Chapter 700: Water Regulations · Article VII. Water Service

In short: To get a water main extended, you apply in writing and pay all construction, engineering and legal costs up front (or into escrow), plus any extra costs. The Village must deny the extension if it would materially harm service to existing customers, and the applicant covers inspection costs.

Our plain-English summary, not the official text or legal advice. The ordinance below is what counts.

A. Extensions of water mains and lines may be made by the Village upon written application on a form approved by the Village. If an application is approved, the main or line shall be extended provided that:

1. The applicant shall pay all construction, engineering and legal expenses of an extension. Payment shall be made in advance to the Village or, at the Village's discretion, may be placed into a special escrow account. If the cost and expense of the construction is not ascertainable, the cost shall be estimated and that amount shall be paid to the Village or put in a special escrow account. The applicant shall pay any additional costs incurred for the extension.

B. Before granting or entering into an Agreement for an extension, the Village shall first determine that the extension shall not materially adversely affect the service rendered to any existing customers. If the Village determines, based upon information provided by its employees and consultants, that an extension would have a material adverse effect upon existing users, then the Village shall not grant an extension.

C. If an applicant desires to perform the construction, the applicant shall pay all engineering, legal and administrative costs incurred by the Village incident to the approval of the plans and specifications for construction of the improvements, the perfecting of all rights-of-way and other costs incident to the construction.

D. The construction and materials shall be inspected by a qualified inspector designated by the Village. The cost of the inspector shall be paid by the applicant. All plans and specifications for main extensions or improvements shall be approved by the Village and the appropriate agency of the State of Missouri.

E. Upon satisfactory completion and testing, the improvements shall be dedicated, free and clear of all encumbrances, to the Village.
