Glasgow Application Requirements ordinance (§ 510.080)

Chapter 510: Regulation of Wireless Communication Facilities

A. In addition to the general application requirements for a special use permit, all applications for wireless communication facilities shall include the following:

1. The name, address, and telephone number of the applicant and the owner and lessee of the parcel of land upon which the wireless communication facilities are to be situated. If the applicant is not the owner of the parcel of land upon which the proposed tower is to be situated, the written consent of the owner shall be evidenced in the application. If the applicant is not the owner of the property, a copy of the preliminary lease agreement is required to be provided with the application. A copy of the final agreement shall be submitted prior to issuance of a building permit for the structure.

2. The legal description and address of the parcel of land upon which the proposed tower is to be situated.

3. A vicinity map, identifying the location of the property in relation to at least one (1) intersection of two (2) streets shown on a map of the City.

4. A site plan consisting of a scale site drawing clearly setting forth the location, ground elevation and height above ground. In preparing the plan and drawing the following shall be included:

a. The boundaries of the property on which the facility is located expressed in feet;

b. The specific placement of the antenna support structure and all ancillary equipment on the site with dimensioned setbacks from property lines expressed in feet;

c. The location of existing structures on the site with dimensioned setbacks from property lines;

d. All existing structures, lot lines and roadways within one hundred eighty-five (185) feet of the site;

e. The type and height of the proposed tower expressed in feet;

f. Ground elevation at the base of the structure in feet according to USGS datum;

g. Proposed means of access to the site; and

h. The location of existing trees, and other significant site features, the type and location of plant materials fencing used to screen the facility, and any other proposed structures or improvements.

5. A design report prepared, signed and sealed by a Missouri registered professional engineer setting forth the design criteria used, the structure antenna capacity by type and number, and calculations verifying that the tower and tower foundation have been designed to withstand winds in accordance with ANSI/EIA/TIA 222 standards as now exists or later revised. The design report shall set forth supporting data needed to bear out the conclusions reached in the design report, including but not limited to soil investigation reports, manufacturer's dimensional and weight data and material specifications issued by tower and/or equipment manufacturers.

6. A visibility evaluation report (if not included in the design report), including architectural renderings and/or photo simulations of views of the tower from nearby properties and streets; and architectural drawings of the proposed tower and all associated facilities and equipment at the proposed location.

7. Documentation demonstrating the need for the proposed tower at the site selected and indicating why design alternatives cannot be utilized to accomplish the provision of Section 510.060(A)(4)(a) above.

8. An affidavit attesting to the fact that the applicant made diligent efforts to obtain permission to install or collocate the proposed telecommunications facility on existing towers or antenna support structures located within a two-mile radius of the proposed tower site, but due to physical, economic, or technological constraints, no such existing tower or antenna support structure is available or feasible.

9. An affidavit attesting to the fact that no suitable site owned by any agency of the Federal or State government, or by any political subdivision of the State, is available for locating the structure or tower.

10. A written statement signed and sealed by an RF Missouri registered engineer attesting that the construction and placement of the proposed tower and telecommunications facilities will not interfere with public safety communications and the usual and customary transmission or reception of radio, television, or other communications services enjoyed by adjacent residential and non-residential properties with an acknowledgment by the applicant that interference that does take place must be corrected.

11. A written statement by the applicant assuring that the tower and telecommunications facilities will comply with all standards established by the Electronic Industries Alliance and all applicable Federal, State and local laws and regulations.

12. If collocation is proposed, the applicant shall provide a signed statement indicating that the tower will accommodate collocation of additional antennas for future users and it is their intent to share space on the tower with other providers at a reasonable, market-based cost.

13. If collocation is proposed, the applicant shall provide written technical evidence from an engineer(s) of the proposed tower's capability of supporting additional telecommunications facilities comparable in weight, size, and surface area to the telecommunications facilities installed by the applicant on the proposed tower (if not included in the design report).

14. The applicant shall demonstrate how the proposed site fits into its overall telecommunications network within the City. This shall include a service area coverage chart for the proposed tower and telecommunications facilities that depicts the extent of coverage and corresponding signal quality at the proposed tower height and two (2) additional charts at fifteen-foot intervals lower than that proposed.

15. Copies of any environmental documents required by any Federal, State, or local agency, if available (if not included in the design report). These shall include the environmental assessment required by FCC Para. 1.1307, or, in the event that a FCC environmental assessment is not required, a statement that describes the specific factors that obviate the requirement for an environmental assessment.

16. A written statement describing what analysis has been made to assure that FCC RF radiation standards will be maintained after all planned antennas are installed.

17. Applicant shall at the time of making application place into escrow the sum of two thousand five hundred dollars ($2,500.00) to be used by the City for application expenses, including the need to obtain the services of an independent, qualified engineer to validate and review the legal and technical information contained in the application documents, including but not limited to local code reviews, structural engineering, and geotechnical engineering. The funds shall also be used by the City to obtain the services of a court reporter and for transcription of hearing records if applicant or the City requests that the hearing before the Planning and Zoning Commission be on the record. Unused escrow money will be returned to applicant.
