Glasgow Service Charges ordinance (§ 230.330)

Chapter 230: Solid Waste

In short: Every home and business receiving city trash service pays a monthly service charge, set by the city's contract with the hauler (businesses arrange their own rate). It's billed on the water bill, stops when a unit is proven unoccupied, and unpaid charges can bring a lawsuit plus attorney's fees.

Our plain-English summary, not the official text or legal advice. The ordinance below is what counts.

A. There is hereby imposed, for the collection and disposal of solid waste, a service charge for each dwelling unit and each commercial establishment to which such service shall be provided under the provisions of this Chapter.

1. The service charge for collection of residential solid waste shall be in the amount determined by the City of Glasgow's contract with the disposal company or agency then servicing the City and shall be charged per calendar month.

2. The service charge for each commercial establishment will be determined by arrangements entered into by the commercial establishment and the company or agency which has contracted with the City of Glasgow to provide for the collection and disposal of solid waste within the City.

3. The service and service charge shall be terminated upon presentation of satisfactory proof to the City that any such dwelling unit or establishment is unoccupied, and shall be commenced upon renewed occupancy thereof.

4. The system of services established by the provisions of this Chapter is designed as an integral part to the City's program of health and sanitation, to be operated as an adjunct to the City's system of providing potable water and the City's system for providing sewage disposal. The City may enforce collection of such charges by bringing proper legal action against the occupant of any premises which has received such services, to recover any sums due for such serviced plus a reasonable attorney's fee to be fixed by the court.

5. The service charge herein provided for is hereby imposed upon the occupant of each dwelling unit receiving such service under the provisions of this Chapter and billing therefor shall be made to the person contracting for City water and/or sewage service of for other water service or otherwise providing water service to each dwelling unit. In the absence of information that such person is neither the owner nor the tenant of such dwelling unit, in which event billing therefor shall be made to the owner. Service charges shall be payable to the department empowered to collect service charges impose by the City.

6. The City shall bill the service charge on the monthly water bill or as otherwise provided by separate agreement with the person or entity responsible for paying the charge. Delinquency time computation and determination of late penalties and collection of charges and penalties shall be made in accordance with the collection procedures and policies set forth for collection of the municipal water bills.
