Fulton Local tobacco sales permit required ordinance (§ 72-9)

(a) No person shall sell tobacco products, alternative nicotine products, or electronic smoking devices in the City of Fulton without first obtaining a local tobacco sales permit issued by the city clerk.

(b) The fee for each permit shall be $50.00 per year, payable at the time of issuance or renewal. Each business location shall require a separate permit.

(c) Permits shall expire on the last day of February each year and must be renewed on or before that date. The city clerk shall send renewal notices to each permit holder in advance of the deadline.

(d) All fees collected under this section shall be placed in a designated account for the enforcement and administration of this chapter.

(e) A permit may be suspended or revoked for repeated violations of this chapter, following notice and an opportunity for hearing under section 72-10.

(f) A local tobacco sales permit shall not be transferable to a new owner upon the sale or transfer of a business. The new owner must apply for a permit, which shall not be issued until approved by the city council.
