Chapter 46: Environment · Article I. Unsafe Buildings

The following standards shall be followed in substance by the building inspector and the building commissioner in ordering repair, vacation, or demolition of any dangerous building.

(1) If the dangerous building is occupied and in such condition as to make it dangerous to the health, safety, or general welfare of its occupants, it shall be ordered to be vacated and then repaired or demolished.

(2) If the dangerous building reasonably can be repaired so that it no longer will exist in violation of the terms of this chapter, it shall be ordered repaired prior to ordering any demolition.

(3) If the dangerous building cannot be reasonably repaired so that it no longer will exist in violation of the terms of this chapter or if it is not repaired as ordered pursuant to this chapter, then it shall be ordered demolished.

(4) Whether a dangerous building can reasonably be repaired shall be determined in the discretion of the city building inspector or building commissioner, as the case may be, considering the time and expense of any repairs, the costs of demolition and removal, and the value of the dangerous building and the property.

(5) Any dangerous building that is not repaired pursuant to the orders issued under this chapter shall be presumed to be unable to be reasonably repaired.
