Fulton Impact fees for northwest sanitary sewer improvement project ordinance (§ 114-222)
Chapter 114: Utilities · Article IV. Sewers and Sewage Disposal
(a) A new sewer main beginning just west of the intersection of Stinson Creek and Hwy. 54 has been constructed by the city. This main extends north toward State Route HH to accommodate existing and possible future citizens of the city.
In order to offset the cost of the construction of this sewer main, the city is charging those residing in the improvement area an impact fee which exceeds the current $50.00 inspection fee for connecting to the main. The improvement area encompasses all of the properties inside the city limits which have or would potentially have sewer that will drain to this sewer main or one of its future branches. Citizens will be required to connect to this new main when it is within 100 feet of any property line of their structure (see section 114-175). This would include existing and proposed structures (see section 114-220). Those not currently inside the city limits who wish to connect to this sewer main must first be annexed by the city before they would be allowed to connect (see section 114-231).
(b) The impact fee assessed to those lying within the improvement area shall be according to the following:
New residential single family dwellings:
Acreage of lot multiplied by $3,000.00 per unit.
Minimum fee = $1,000.00 per unit.
Maximum fee = $3,000.00 per unit.
Examples:
0.5 acre lot = 0.5 × $3,000.00 = $1,500.00 fee per unit.
0.25 acre lot = 0.25 × $3,000.00 = $750.00, $1,000.00 fee per unit
5 acre lot = 5 × $3,000.00 = $15,000.00, $3,000.00 fee per unit.
New multi-unit dwellings:
First unit:
Acreage of lot multiplied by $3,000.00.
Minimum fee = $1,000.00.
Maximum fee = $3,000.00
Additional units = $500.00 per unit.
Examples:
Duplex on 0.75 acres = 0.75 × $3,000.00 = $2,250.00.
1 additional unit = $500.00.
Total = $2,750.00.
Apartment with 8 units on 1 acre = 1 × $3,000.00 = $3,000.00
7 additional units = 7 × $500.00 = $3,500.00.
Total = $6,500.00.
New commercial property:
$3,000.00 per acre.
Minimum fee $1,000.00 per unit, whichever is greater.
Existing commercial or residential property:
No impact fee is assessed.
Property holder must adhere to section 114-220 and abandon, clean and fill any septic tank, cesspool, and any similar private sewage disposal facility within 60 days after connection to the public sewer system.
These impact fees do not include the cost in making the physical connection to the sewer main. This connection shall be made by the property holder under the supervision of the city (see section 114-176).
Impact fees shall be paid to the city before services are allowed to connect to the public sewer main.
(c) The expansion of this public sewer main is contingent upon the acquisition of easements. All easements necessary for this sewer expansion would be required before the start of construction. Easement acquisition would need to be a cooperative effort between the city and the citizen or citizens wanting the public sewer. The city would request that all easements be given to the city so the cost of construction is not increased. If easements are not given, the city council will decide the price per foot that the city will pay for all easements in the improvement area and in turn, whether the impact fees outlined above need be adjusted.
(d) The design and development of sewer mains for future subdivisions in the improvement area would still be the responsibility of the developer. During the city's review process of these subdivisions, the city may wish to modify the developer's design in order to accommodate any further expansion of the sewer main. The city may compensate the developer for these modifications.
