Fulton Utility easements ordinance (§ 102-60)
Chapter 102: Subdivisions · Article III. Design Standards
(a) Utility easements shall be of sufficient width to have at least a ten-foot interval between water and sewer lines. Where practicable utility lines shall be placed in streets, alleys or easements.
(b) Unless determined in writing to be unnecessary by the city engineer, easements of not less than ten feet in width shall be provided on each side of all rear lot lines, and alongside lot lines where necessary for storm and sanitary sewers, overland stormwater paths, gas, water, and other means and for electric and telephone lines or for other public utilities. Easements of greater width may be required along or across lots when necessary for the extension of main sewers, sewers in excess of eight feet of cover, or other utilities or where both water and sewer lines are located in the same easement. A two-foot easement shall be required on one side of and adjacent to an alley to accommodate pole lines.
(c) Adequate easements for stormwater drainage shall be established along any natural drainage channel and in such other locations as may be necessary to provide satisfactory conveyance of stormwater from streets, alleys, and all other portions of the subdivision. The location and minimum widths of such easements shall be determined by the city engineer.
(d) No structure shall be placed or erected in any easement for utility or drainage purposes or within easements except at the owner's risk as to all costs for demolition, removal, and/or reconstruction, and the proper authorities may have free access to and use of the easements at any time. By way of example, structures disallowed to be placed within easements or within street right-of-way include buildings, swimming pools, permanent retaining walls, fences that obstruct the functionality of the easement, garages, sheds, gazebos, pool decks and pool equipment, or other obstructions that interfere with the access to or functionality of the easement.
