Fayette Payments and Penalties ordinance (§ 215.450)
Chapter 215: Nuisances · Article V. Disorderly Properties
A. The Chief of Police shall notify the City Clerk of each Police response to a property that has been designated a disorderly property.
B. The City Clerk shall issue a bill to the owner of the property for each Police response. The bill shall be payable thirty (30) days after mailing.
C. A person is exempt from liability for the fee established by Section 215.430(A) if:
1. The person is a Federal, State, or local government agency;
2. The property or unit responded to is used exclusively for nonprofit religious, cemetery, hospital, or educational purposes;
3. The municipality has not provided notice to the person in writing as provided in Section 215.430(B).
D. All bills not paid within the designated time shall accrue a late penalty of twenty-five dollars ($25.00) per month.
E. Any property owned by an owner who is more than sixty (60) days in arrears for any payment provided herein shall not be rented or leased.
F. If any owner is more than ninety (90) days in arrears for any payment provided herein any business license held by such owner shall be terminated.
G. If a property has more than one (1) owner, all owners shall be jointly liable, with the tenant, for any fee imposed under this Section. Actual notice to one (1) owner creates a rebuttable presumption of actual notice to all other owners.
H. If the unit requiring excessive Police responses is a manufactured home located in a manufactured home park, the fee may not be imposed on the owner or operator of the manufactured home park, unless the owner's or operator's conduct required the excessive Police response or the owner of the manufactured home park also owns the manufactured home.
I. The fee may be collected in any lawful manner, including bringing an action in court for a personal judgment against any one (1) or more of the persons liable.
