Boonville Qualifications; conflicts of interest prohibited ordinance (§ 2-73)
Chapter 2: Administration · Division 5. City Attorney and City
No person shall be eligible to hold the office of city attorney or city counselor unless he or she is a person licensed to practice law in Missouri. During the term of office for which such person has been elected, the city attorney is prohibited from representing any party other than the city, the state, or any of its political subdivisions, in any criminal proceeding or municipal ordinance case or proceeding in which the city police department is the investigating law enforcement agency for such case, or has assisted another law enforcement agency in the investigation of such case. Nothing herein shall be deemed to preclude the civil practice of law by the city attorney or the city counselor, except in such cases involving the city police department or where such representation would be directly adverse to the interests of the city. Because the city counselor and city attorney are public officers of the city, neither shall engage in activities in which his or her personal or professional interests are, or reasonably could be, in conflict with the professional duties and responsibilities of such person's office. While in office, neither the city counselor nor city attorney shall assume or undertake representation of any client other than the city if such representation will be directly adverse to the city or its interests. It shall be deemed a conflict of interest for the city attorney to file any complaint in the municipal division of the Circuit Court of Cooper County, Missouri against any person the city attorney currently represents in a civil matter or where the city attorney currently represents any victim of the alleged crime.
