Boonville Application review by the BHPAC ordinance (§ 17-68)
Chapter 17: Planning and Redevelopment · Article IV. Historic Districts
When a completed application for an historic property construction permit has been submitted to the BHPAC, the BHPAC shall:
(1) Add the application to the agenda for the next regular meeting for review. The BHPAC may call a special meeting to review routine applications when delay to the next regular meeting would create an unnecessary inconvenience to the applicant. An historic property construction permit may be issued prior to the next regular meeting upon the signatures of four members of the BHPAC.
(2) Review of all applications submitted by the first of the month shall be completed by the fifteenth day of the month. If the BHPAC cannot meet the time frame specified due to lack of a quorum, and the applicant requires a decision, the chairman of the BHPAC or the chairman's designate shall have authority to approve or deny a permit.
(3) Approval or denial of the application may be made upon consideration by the BHPAC or within 15 days if additional information is required.
(4) Upon approval by the BHPAC, an historic property construction permit may be issued by the building inspector.
(5) If the project is not completed as described on the application, the project shall be deemed in violation of this article.
(6) A denial of an application shall be accompanied by a statement of the reasons for the denial. The BHPAC shall make recommendations to the applicant concerning changes or additional information needed in the application which would cause the BHPAC to reconsider its denial. The BHPAC shall confer with the applicant and attempt to resolve as quickly as possible the differences between the owner and the BHPAC. The applicant may amend the application during the review process or reapply at a later date. (7) If the BHPAC fails to approve or deny the application within 45 days of its submission in final form, then the application will be automatically approved.
(8) Once an historic property construction permit has been issued by the BHPAC, any minor changes, as determined by the BHPAC chair or his/her designee, may be approved by the BHPAC chair or his/her designee without submitting a new application. All major changes to the permit require full review by the BHPAC.
